CAI Hui
Areas of Practice Mr. Cai is specialized in Civil and Commercial law, Intellectual Property Law as well as financial insurance, project financing, enterprise restructuring, M&A and asset restructuring. As an attorney, he has handled many influential cases. In 2007, he represented MMIM Technologies in the MMIM Technologies Ltd. v. Tencent, Inc. unfair competition case named one of the ¡°Top 10 IP Cases of 2007¡± by the Beijing High People¡¯s Court. Also in 2007, he represented Hubei Provincial Seed Group Co. Ltd. in a tort case for malicious litigation against OriginAgritech Inc., the said case being recognized as China¡¯s first case of malicious litigation constituting tort. In 2006, n the Beijing Universities Real Estate Development Corporation(BURED Corp.) v. Capital Asset Management Limited Corporation fund management case involving RMB130 million he represented BURED Corp. In 2005, he represented Angel Yeast Co., Ltd. in the Angel Yeast v. Youyuan Asset Mangement Ltd. et. Haitong Securities fund management case involving RMB70 million. In 2003, he assisted Citibank Group in bidding for the Wuhan Non-performing Assets Package of China Huarong Asset Management Corporation. In 2002, as a judge with the Hubei High People¡¯s Court, he presided as presiding judge over the judicial determination of ¡°Gome¡± as a famous tradmark, the said case being referred to as the first case of its kind.
Working Experience
Mr. Cai joined Lifang as a partner in 2003. Prior to that, he worked with Hubei High People¡¯s Court Province where he sat as a judge for No. 1 and No. 3 Civil Branches between 1997-2002. During his term on the bench he participated in research into several judicious interpretations of the Supreme People¡¯s Court and took charge of instruction and coordination of civil cases across the province.
Education Mr. Cai holds an LLM(Civil and Commercial Law) from the Law School of People¡¯s University of China and an LLB from Zhongnan Politics & Law University.
Qualifications Mr. Cai became a China licensed lawyer in 1995 and a China licensed judge in 1997.
Publications Mr. Cai has had more than 10 articles published on such subjects as Consumer Protection Law, research on the practice of legal protection of personal right, and adjudication practice of real estate cases.
